Terms and Conditions

 

Throughout these terms and conditions, Goods refers to the shutters as supplied and installed by Jobdun Joinery Limited trading as The Little Shutter Shop and purchased by you. The Little Shutter Shop, Us, Our, Ours, We refers to Jobdun Joinery Limited. You, Your, Yours, Buyer refers to the customer purchasing the goods from The Little Shutter Shop for personal purpose.

A. Our Contract A.1 This website constitutes an online shopping facility for You to purchase shutters at retail price for the purpose of self installation and/or using our installation services. A contract between You and Us shall be deemed legally binding upon our acceptance of Your order.

For all customers , Acceptance of Your order will be confirmed by an e-mail which will be sent to You following receipt of Your order.

B. Price B.1 The price as detailed on the order summary section will be the price payable for the Goods. This price includes all applicable UK taxes. B.2 Upon acceptance of Your order as per section A.1, We shall debit the price of the Goods from Your chosen method of payment.

B.3 Upon installation of Your order as per section A.1, Payment of agreed fee will be taken on the day of installation from Your chosen method of payment.

C. Cancellation of an Order by You C.1 The Little Shutter shop adheres to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 a legislation which offers certain cancellation rights when You buy online or by phone.

C.2 You are entitled to cancel Your contract if You so wish, provided you exercise your right no later than 14 days after the day on which you receive Your Goods or services.

C.3 Your right to return Goods does not apply to Goods made to Your specification or that have been clearly personalised. (see clauses C8 and C9 below)

C.4 If You wish to exercise Your right of cancellation, You are obliged to retain possession of the Goods and take reasonable care of them.

C.5 To exercise Your right to cancel, You must inform Us of Your decision to cancel Your contract by a clear statement, including details of Your name, geographical address, details of the order You wish to cancel and where available, Your phone number and email address.

C.6 If You decide to cancel, you must return the Goods to Us at Your cost within 14 days of such cancellation and We will reimburse You (by the method used to pay for the original transaction) the amount in relation to Goods to which cancellation rights apply. This includes the cost of delivery.

C.7 We may make a deduction from the reimbursement for the loss in value of any Goods supplied, if the loss is the result of unnecessary handling by You. We will make the reimbursement 14 days after the day We receive back from You any Goods

C.8 Orders for Goods made to Your specification personalised may only be cancelled and refunded if You request this before the production of Your Shutters begins. A Cancelled order at this stage can be refunded but carries an admin fee of £150.00 to cover Our costs.

C.9 Orders for Goods made to Your specification personalised which proceed to production cannot later be cancelled. It may sometimes be possible to amend the paint colour, but only if this stage of the process has yet to commence. Please contact Us for clarification.

D. Order Cancellation by Us D.1 On certain occasions it may be necessary for Us to cancel Your order. This may be due to a production issue with Our suppliers, or other circumstances outside of Our control. In the unlikely event of this We will notify you and re-fund any money debited at order placement. D.2 We will not be liable for any compensation payment in the event of order cancellation by Us. D.3 The Little Shutter Shop will have no liability whatsoever to You for any damage or consequential loss caused by The Little Shutter Shop cancelling Your order in accordance with clause D.1 above.

E. Product Description E.1 The Little Shutter Shop is under a legal duty to supply Goods that are in conformity with the contract.

E.2 The Little Shutter Shop has taken all reasonable care to ensure that the information displayed on this website is accurate, correct and true. If You are in any doubt about the information as conveyed by Us, please contact Us prior to placing order. E.3 As with all wooden products, shading differences may occur between the colours as displayed and that seen in the finished Goods as purchased by You. We cannot accept any returns or authorise any refunds for any disappointment resulting from natural shading variations. E.4 As the product is viewed online, colour variations do occur between monitors. We therefore recommend customers book an appointment with Us to view products before purchasing as We cannot be held liable for any variations between colours viewed online and the finished product received.

E.5 All goods should be fully inspected by You before installation. You must check that Goods are in accordance with Your purchase order both for measurements and design before installation.

F.Product Measurements F.1 The Little Shutter Shop offers a complete measure, supply and installation service. For those requiring supply only The Little Shutter Shop has taken all reasonable care to ensure this website provides as much product information as possible to help You in achieving correct measurements of Your window for Your Shutters. Please contact Us for instructions regarding measurements. Please note that if You are in any doubt relating to measurements, please contact Us before order placement.

F.2 If the measurements You supply to us vary from Your actual requirements we cannot accept any liability for any consequential losses either direct or indirect and cannot accept return of the Goods or issue a refund in respect of the Goods, provided that the Goods have been manufactured in accordance with the measurements You supplied to us.

F.3 Following receipt of your order We will contact You to confirm You have provided the correct measurements. For all Inside Mounted Shutter orders we advise You that a standard deduction of 2mm from Your submitted width and drop dimension is made, this is for ease of installation. (You are given the choice not to have these deductions made). F.4 Manufacturing tolerance levels of overall panel and frame specifications are plus or minus 2mm, and the product will not be considered defective if falling within the size range. Warp on any component part, vertical or horizontal, shall not exceed 1mm per 300mm. F.5 Horizontal middle rail location: This location may be off by half a louvre.

For 47mm louvre can be off by +/-19mm. For 64mm louvre can be off by +/-25mm. For 89mm louvre can be off by +/-38mm. For 114mm louvre can be off by +/-51mm.

G. Delivering Your Goods. G.1 We will dispatch Your Shutters as soon as the goods are ready. While We quote a lead time of 10 weeks for delivery of Your shutters, these are estimates only. While We make every effort to ensure that delivery times are met We cannot accept responsibility for any damage or consequential loss arising out of any delay. G.2 On delivery of Your Shutters please ensure boxes are undamaged. You must sign the couriers delivery note and if damage has occurred ensure this is noted on accepting the goods. The Little Shutter Shop will not take any reasonability for goods damaged in transportation, which have not been signed for as ‘damaged’. G.3 Fixed £20 delivery and all stated delivery prices apply to Mainland UK addresses only. Delivery to Scottish Highlands / Off Shore & Channel Islands, NI, Eire and Europe are deemed outside Mainland UK and will incur some additional charges. Please contact Us for prior confirmation or submit order through website and we will contact you to confirm charges. G.4 Ownership and title of the goods will pass to You upon delivery.

H. Liability H.1 Supply only customers – As the product is installed by You or a third party, The Little Shutter Shop cannot accept any responsibility for damage made to the Shutters at installation. You are provided with full instructions however if You do not understand any part of the procedure please contact Us for help before You install. H.2 If You choose to pay a third party to install the Shutters and problems arise during installation We will not accept any liability for the work carried out by such third parties. H.3 We give no warranty as to the fitness of the Shutters supplied other than that of an internal window dressing. Other installation and uses are at Your own risk.

I. Defective Goods I.1 All Shutters supplied by The Little Shutter Shop are covered by a guarantee against defects in craftsmanship or materials. The guarantee period for Plantation Shutters is 36 Months.

The applicable guarantee period begins when the Goods are delivered to You. If Your goods arrive damaged or there is a defect in manufacturing, You must report this to the The Little Shutter Shop OFFICE WITHIN 14 DAYS OF RECEIPT OF THE GOODS. Any issues You report to Us need to be accompanied by photographic evidence. The Little Shutter Shop cannot be held responsible for any damage or defect once the 14 day reporting time has lapsed. I.2 Return of defective Goods will only be accepted with prior notification. In the first instance, You must contact Us via e-mail or telephone to explain the problem. In the event that the Goods are defective We will arrange for collection of the Goods via courier at Our expense. If the Goods are deemed defective due to misuse or due to incorrect measuring or ordering then all related costs of shipping will be passed on to You. I.3 We shall not be held liable for any costs incurred by You or any third party who has been employed by the Buyer to install the shutters. In the event of defective or damage shutters needing to be replaced, we shall not be responsible for any costs incurred by You for the refitting of the replacement shutters or for room decorating. I.4 If the Goods are deemed defective, We will not automatically issue You with a refund. We will offer You replacement of the Goods or a suitable alternative as deemed by us. I.5 Goods that have been used in unsuitable conditions (excessively humid or in a high moisture environment or using interior shutters in an exterior environment) or having been subjected to irregular use may not be deemed acceptable for return as detailed in clauses H.1- H.3

J. Payment Security J.1 We pledge to You to retain all credit card and payment information within a completely secure environment, taking all reasonable care to ensure no other party outside of The Little Shutter Shop has access to this information.

K. Governing Law K.1 This contract is subject to the English Law and the exclusive jurisdiction of the English courts. We reserve the right to change these Terms and Conditions without prior notice.

L. Customer Data & Privacy Policy L.1 We take your privacy very seriously, and to enable us to provide details of your order at a later stage, we do need to retain a certain amount of personal information. Under no circumstances will we share your information with third party companies for marketing purposes. We only share details with parties working on our behalf to complete your order.

We collect the following information when your order is placed.

  • Home Address and Postcode
  • Delivery Address, Postcode & Telephone Number
  • Password
  • Credit Card Details i.e. Credit Card Type, Number, Expiry Date, Security Number etc.

As required by the UK Data Protection Acts of 1984 and 1998, we follow strict procedures in the storage and disclosure of all information, which you have given us in order to prevent unauthorised access.
